11 Coventry operator Sean McMulty, trading as Dairy Farm Products, was fined £145 by Rugby Magistrates for offences committed on the first day that his new vehicle was put on the road.
McMulty pleaded guilty by letter to a 13.45% front axle overload, using a vehicle without an operator's licence, and failing to use the tachograph. The driver, Matthew McMulty, was fined £100 for the axle overload and for failing to use the tachograph.
Peter Wiseman, prosecuting for the West Midland Traffic Area, said that McMulty held an operator's licence but the vehicle had not been specified on it. When interviewed he said he had recently bought the vehicle and put it on the road the day it was stopped. He had been unaware that there was no tachograph key when the vehicle went out.
