Ian Simpson, HM principal specialist inspector (mechanical engineering) and the Health and Safety Executive confirms: "The legislation is not retrospective, moreover there is no transition period between the new and old directives: the swap-over occurred on 29 December."
With regards to how the HSE will look for conformity within existing and new products, Simpson states: If manufacture of the product was completed before 29 December and the declaration of conformity was to the old directive, then dcl stock can be sold after 29 December. However, if manufacture was completed after 29 December, the product will have to meet the new directive."
Simpson adds that in practice: "With a loader crane, the product is generally manufactured by Company A and then fitted to the chassis by Company B. Company A are responsible for making the declaration and applying the CE mark. Company B should follow the instructions contained within the instructions provided by Company A."
