A less contentious proposal included in the FITD reports discussed by both committees was the EC's amendment to night-work regulations. It wants to redefine 'night work' so that the definition only applies if work has been carried out for at least two hairs within the period between 00.00 to 07.00, the band of hours defining 'night time', At present, 'night work' is any work carried out in that period and could be as little as a few minutes. In the UK, 'night time' is defined as 00.00 to 04.00 to take into account delivery patterns.
"The proposal on night work gives drivers greater flexibility," says the FTA's Yarsley. "If you get caught on a motorway, you won't automatically slip into night work when something unexpected happens." Similar to other proposals, this one will face further discussion, but is likely to hit little opposition. "What is night time?" muses Bauer. "It is something different in Finland or Portugal."
