To a certain extent the Operator's Licensing system relies on a self-policing policy as operators are required to notify the Traffic Commissioner of any changes or convictions that might affect their 0-licence.
Failure to notify is a breach of condition on the licence or statute—it can lead to a Public Inquiry and disciplinary action, including revocation. Operators must notify the TC within 28 days of any event which could affect their repute, professional competence or financial standing; or the transport manager's repute or professional competence. Operators must also notify: • Additional vehicles; • Removal of and replacement of vehicles; • Temporary substitution for broken-down vehicles; • New operating centres; • The transfer of vehicles from one Traffic Area to another; • Changes in the organisational, management shareholding which affects the control of the business; • A change of business name; • The replacement, removal or addition of a nominated person of professional competency; • Anything which could affect the repute or professional competence of the operator or transport manager or their financial standing; • The death or bankruptcy of the operobr, director or partner; • The liquidation of the company; • Convictions, • Changes in maintenance arrangements.
