by the article by " Janus " in your issue of September 28, dealing
with balancingcharges on the prices of vehicles compulsorily acquired under the Transport Act, 1947. It is thought that readers:may feel that the Road Haulage Association have given up the fight on behalf of those affected. That is not the case. The Association have a special committee dealing with this problem, and after taking test cases have consulted counsel and been in constant discussion or correspondence with the Inland Revenue.
The present position is that consideration is being given again to further test cases to deal with the point that is mentioned in the article, namely the open market value of the vehicles at the date of acquisition. As with other tax matters this is not one that can be disposed of quickly (it has already taken six to seven years), but the final decision has not yet been reached.
a28 The Association have advocated that road hauliers affected by balancing charges should endeavour to defer final settlement until the main issues are decided as between the Association and the Inland Revenue. As soon as that is done, full publicity will he given to the position.
