0 A Manchester industrial tribunal has decided that A Aplin Transport was entitled to sack a driver for claiming expenses he was not entitled to, even though it did not hold a disciplinary hearing.
The tribunal rejected a compensation claim for unfair dismissal from driver Anthony Lancaster. It said that Lancaster had been employed in a small haulage business and was trusted to carry out his duties in an honest and efficient manner.
Lancaster had previously been warned that he would be dismissed if he made unjustified claims for expenses but he claimed reimbursement for two private phone calls from his home to Aplin's premises without the necessary authority. The Tribunal was satisfied that this was an exceptional case where the firm could have reasonably concluded that to hold a disciplinary hearing would have been futile, and would have made no difference to the fairness of the dismissal.
