Preston-based Huntapac Produce runs a 26-vehicle fleet carrying vegetables round the UK, including Scotland.
Transport manager Gerard Palmer, a member of the CM Operators' Panel, says: "Vehicles crossing the border are deemed to be an extension of the premises. But it's also an extension of the driver's home. If you are on a 13-hour or 15hour trip then that's your home, maybe five nights a week.
"You're spending more time sleeping there than in your actual home. So why can't he smoke in his extended home?"
