Which of the following most accurately describes the problem?

There are a whole host of actions or inactions a driver can be responsible for which can leave an operator at risk of prosecution. They include failure by the driver to: • Use a tachograph chart; • Move the mode switch; • Enter centrefield details correctly; • Record all work activity on the chart; • Hand the chart in within 21days; • Report a defective speed limiter or tachograph and continue driving the vehicle; • Avoid exceeding the permitted axle, gross and train weights; • Carry out a daily check of a vehicle without finding any defective tyre, broken headlamp or loose wheelnut it might have.

These are examples of "absolute liability" or "strict liability" offences, where the operator is responsible for the acts of any employed drivers.
