II The Solicitor General has this week given permission for a second legal challenge to be brought in relation to the inquest Into the death of man run over by a refuse truck in Brighton.
Stephane Aineto, a 28-year old Frenchman, died in the early hours of a Sunday morning in July 2001 after falling under the wheels of a dustcart which had passed a no-entry sign to enter a pedestrianised area of East Street. It was being operated by waste disposal firm Site. In December 2001 the City canner ruled a verdict of accidental death.
However, Alneto's family has long demanded an inquiry Into the coroner's inquest claiming that much of the potential evidence in the original investigation had boon Ignored. In August 2002 (CM 22-28 Aug 2002) the family was granted permission to bring a judicial review by Mr Justice Hooper and now the Sollettor General, the Rt Hon Harriet Harman QC MP, has agreed to a fresh inquest. The two sets of legal proceedings will now be heard together. The original inquest was held with no jury or involvement of the Heath and Safety Executive, which is now holding its own criminal investigation.
