CF Thomas Transport told Hinkley magistrates that its vehicle had been through a full safety inspection and its brakes had been relined just three weeks before it collided with a car.
Despite the failure of the braking system, defending solicitor Anton Bakitis (pictured) of Rotheras argued that under the principles established in the cases Cameo vs Dowse & Son and Hart vs Rex, the firm was morally blameless.
The magistrates agreed and granted the company an absolute discharge.
