John Backhouse, representing Stephen and Shireen Haydock, of Blackburn, argued that the North Western Commissioner had no jurisdiction to hold an inquiry outside the boundaries of his area, unless the operator consented.
North Western Commissioner Keith Waterworth disagreed and said there was nothing in law to pre vent North-Western inquiries being held in the North-East. He did not accept the view that his jurisdiction was limited to holding public inquiries within the boundaries of the Traffic Area.
But Waterworth said that if Backhouse put his legal arguments in writing they would be put to Department of Transport lawyers.
The proceedings were adjourned until a date to be fixed because of a possible pending prosecution against Stephen Haydock for the alleged fraudulent use of a vehicle excise licence and because financial information it was claimed had been posted to the Traffic Area Office had not been received.
