It is an offence to attempt to drive a vehicle with level of alcohol of more than 35mgi 100m1of breath.
What constitutes "attempting" to drive a vehicle is not always clear a truck driver in his cab should not assume that he or she is safe from prosecution, even when parked up for the night.
In 1991 one hapless driver was prosecuted by police even though he was fast asleep in his bunk and the tachograph was set to rest. This case was dismissed -0 but that does not mean a similar prosecution might not convince a court.
