• The Transport Tribunal has up held Scottish Traffic Commissioner Michael Betts' revocation of Central Scotland Recycling's licence. Betts disqualified the company and its sole director, Robert McDonald, from holding an 0-licence for three months for environmental condition breaches (CM 17-23 Sept).
In March, a complaint was received that the Bo'ness company was breaching the conditions. McDonald told a traffic examiner there might have been "rare occasions" when a vehicle had moved out just before 07:00hrs or had been recovered after 17:00hrs following a breakdown. This gave the impression that any movement outside the permitted hours was exceptional. But the company's tachograph records revealed 40 occasions when vehicles had left the premises outside the permitted hours.
McDonald admitted that movements outside the permitted hours had continued up to the day of the inquiry The TC regarded the continuing breach of conditions as one of the most blatant disregards for the 0-licensing rules he had ever encountered.
