Which of the following most accurately describes the problem?

• The government is fighting a legal ruling which would allow Scottish hauliers to escape prosecutions based on roadside cameras.

The Edinburgh High Court ruling allows vehicle owners to refuse to tell police who was driving at the time of an offence because forcing owners to disclose such information is in breach of the European Convention on Human Rights. This was adopted into Scottish law last May: it will become UK law next October.

Cohn Boyd QC, the Solicitor General for Scotland, told the court: "Once the Human Rights Act comes into force in the rest of the UK, a similar issue will inevitably arise."

If the ruling is upheld it will undermine hit-and-run offences, drink-driving offences and render roadside Cameras useless.
