• In a written judgment the Transport Tribunal has dismissed an appeal by the Scottish Central Carting Co. Ltd. against a decision of the Scottish LA varying the B licence of Currie Line Ltd. by the addition of three artics with the condition: -Timber within a radius of five miles of Leith Docks" (CM March 21).
The respondent had applied for six artics conditioned: 'Timber within a radius of 100 miles of operating centre", but the LA feared the granting of such an application woult have created a surplus of transport facilities.
The appellant company appealed on the grounds that it was able to carry out the work for which the respondent's vehicles had been licensed and that it was entitled to preference over the respondent, which, unlike itself, is a newcomer into the haulage industry.
The Tribunal has decided that the appellant did not succeed in proving that, if the application were granted, there would be an excess of facilities.
