• Disciplinary proceedings involving Cardiff brothers Robert and Anthony Powell have been adjourned, pending enquiries into the payment of fines and committal proceedings against Robert Powell over the alleged evasion of VAT, South Wales LA John Mervyn Pugh also adjourned an application by the brothers, as partners, for a new licence authorising 15 vehicles.
It was suggested that an affi davit sworn by Anthony Powell in March this year was false. Fines that were said to have been paid were apparently unpaid. However, Anthony Powell said he believed he was telling the truth at the time. The court had been given post-dated cheques, which were collected personally from his premises by bailiffs. He was asked why he had not mentioned it at the time, "It slipped my mind," he replied Robert Powell maintained he had been unaware of prosecutions until he received a fine notice. He claimed that a .1,650 fine imposed at Caerphilly had been paid in full by his brother.
Asked about a prosecution at Cardiff on 14 March, and a press cutting referring to the evasion of VAT, Robert Powell said: Tin innocent."
However, he admitted committal proceedings were due to take place within the week.
