A haulier and his driver have been ordered to pay fines and costs totalling £905 for using a vehicle in a dangerous condition and falling to use tachograph charts.
Anthony John Francis, of The Squirrels, Hertford, pleaded guilty before Harlow Magistrates to using a vehicle with inefficient brakes, using it in a dangerous condition, and failing to have his driver produce a tachograph chart. He was fined £500 and ordered to pay £85 prosecution casts. In addition, his driving licence was endorsed with four penalty points.
Driver Mark Pearce was fined £300 with ITO costs and also had his driving licence endorsed with three penalty points.
Prosecuting for YOSA, Anthony Ostrin said that Pearce was driving a four-axle rigid goods vehicle when it was directed Into the check site. Pearce was unable to produce all his tachograph records. The vehicle was examined by a vehicle examiner who found that it had Inefficient brakes; that seven out of 10 wheel nuts were loose; that the suspension holding down bats was loose and the axle was moving in relation to the suspension. As a result, a prohibition note was put upon the vehicle.
For both defendants, Jeremy Fear told the court that neither knew of the brake defect as the brakes were otherwise in working order. That defect and the loose suspension bolts would have been ascertained on the vehicles next safety inspection and would than have been rectified. He pointed out that tile one tachograph chart produced by Pearce was found to be In order.
