I. and fellow franchisees, are not happy with the new contracts. In theory I am free to work elsewhere when ARC has no work for me. But it is in reality unworkable. The drum on my lorry belongs to ARC and I cannot use it without its permission or paying a hire fee. Therefore, should a rival company, which by definition will also be the case as I only deliver concrete, ask me to work for them. I would be denied the right to use the drum because of the negative effect on ARCS position in the concrete market,
So, contract ARC drivers are not self-employed and free to ply their trade: they are sole workers for ARC. The Inland revenue has indeed got a problem that must be solved with the Amey Roadstone Corporation.
