YOUR ARTICLE Time to rethink WorkingTime' (CM 29 June) gave a well-balanced state of play on Working Time, particularly the various management and union opinions.
I feel comfortable with what is required, and with most of what I read generally on this subject — except when Vosa has something to say, and then I invariably take a few confused steps back.
The last paragraph of your article quotes Vosa's Kevin Rooney as saying that one employer told him he thought time spent on the hard shoulder following a breakdown could be classed as periods of availability (PoA).
Is this not legitimate PoA, provided, of course, that the driver has been told in advance that he will be there fora certain period (one hour, say) before he can he attended?
