In a recent article in your Sound Off section the issue of agency drivers and tachograph charts was raised.
I would like to suggest that even under existing legislation some agencies do have a legal responsibility for the control of the charts.
There are agencies which employ the driver and hold his P45 there. By ensuring his availability when required, the law states that the driver's employer is responsible for ensuring that the driver complies with the law on both hours and records.
All agencies are open to prosecution under "cause or permit" if a driver switching between hauliers failed to take the required daily or weekly rest.
Pending clearer legislation, and given the continuing debacle over the four and half hour driving rule, then maybe hauliers using agencies should push the responsibility back to them. David Drury Grimsby, South Humberside
