If the operator and driver(s) are summonsed, the operator should consider what level of culpability is to be placed on the business and the driver(s) and decide the best course of defence with their solicitor. It is important to do this as soon as possible because if the defendants blame one another there might be a conflict of interest and a need for separate representation.
Operators should think more carefully than individuals about getting representation. Any convictions have to be reported to the Traffic Commissioner within 28 days and, depending on the number or seriousness of the offences. it can lead to a public inquiry, where action might be taken against the operator's licence.
