AN OPERATOR suspected of failing to pay .E85 costs to Vasa following an overloading conviction in 2004 has been granted a new international licence after he produced a receipt proving the money had been paid. It appeared the court had failed to pass it on to Vosa.
The new licence was for a company formed to take over the business of Newton-le-Willows, Merseyside-based haulier William Turton. North-Western Traffic Commissioner Beverley Bell was satisfied that although there had been some vehicle maintenance failings they had been put right.
The TC had been considering action against the licence held by Turton,tradingasMKnightExpress, together with an application for a new international licence for 14 vehicles and 11 trailers by M Knight Ltd. For the company, Andrew Woolfall said that if its application was granted, the sole trader licence would be surrendered, Turton had been advised to form a limited company because of the growth of the business.
Vehicle examiner Stuart Bailey agreed that roller brake testing and further driver training should solve the problems found during a maintenance investigation.
Turton said that due to his ill health, the business was effectively being run by his wife and son; he would do about 20 hours a week.
After the TC said she was advised that costs of £85 awarded to Vasa following an overloading conviction at Rochdale Magistrates in 2004 had not been paid, Turton produced a receipt from the court showing they were paid at the time. The TC said it was clearly a matter between the court and Vosa.
In granting the licence, the TC said that exceptionally she would accept the surrender of the sole trader licence.
