Q Last July it was reported in Commercial Motor that the overloading tolerance was to be increased from 5% to 10%.
Is that tolerance still subject to an upper limit of one tonne?
A The Vehicle Inspectorate's policy on overloading tolerances is that a vehicle which exceeds a weight limit by more than 5% will be prohibited from going further until the weight is reduced to the legal limit.
A prosecution for an overload will not be instituted unless the excess is over 10% of the legal limit.
But both tolerances are subject to a maximum of one tonne, which means that if a limit is exceeded by a tonne, even if the excess is not over 5% or 10%, a prohibition will be imposed and a prosecution will follow.
