• Fife haulier Thomas Muir (Haulage) has won a second appeal to the Court of Session that will allow it to resume trading until its 0-licence case is heard again later this year.
The company, whose Operator's Licence was revoked for the second time just before Christmas, will now be able to operate until the Transport Tribunal decides whether to uphold the ban. No date has been set yet for the hearing.
Muir runs 50 vehicles and 18 trailers mainly on tipper work out of its depot in Kirkcaldy, Fife.
Scottish Deputy Traffic Commissioner Keith Waterworth reheard the Muir case after it appealed against Scottish IC Michael Bett's original decision to revoke its licence in May 1995.
Despite hearing a plea from Muir that it had spent £450,000 on maintenance last year, a record that showed 53 immediate prohibitions in the past Eve years resulted in Waterworth revoking the licence again.
