Takeover sacking goes to tribunal

• The Transport and General Workers Union is taking a gas distribution haulier to an industrial tribunal after a driver was given the sack shortly before the firm was taken over. Workington-based Solway Heaters, which was bought by Calor Gas late last year, sacked driver Max McMullen after he rejected new employment terms set to be implemented when Calor took over, says the T&G. The union says McMullen, who left before Calor took over, was given no notice before being dismissed and because of this is owed money in lost wages.
T&G officer Ron Graham says: "We believe Solway has a case to answer because if a contract is severed some kind of notice must be given to the employee,"
McMullen had been driving for Solway for seven years on commercial gas deliveries, The tribunal was set for 27 January in Carlisle but has now been adjourned until later in the year.
Solway will not comment.
