• The Freight Transport Association says that French national law could provide a better route to compensation for losses incurred during the recent truckers' blockades than the Treaty of Rome.
The FTA says there is a precedent for claims under Article 92 of law 83-8, dated 7 January 1983. These could be dealt with directly by the French courts.
Dave Green, FTA controller of international affairs, says: "This law places a strict liability on the French government for illegal acts performed by its citizens, provided the government failed to act within a reasonable length of time."
The association will argue that the French government acted too slowly to bring the situation under control.
But Green warns: "I have to say that realistically this is only going to be worthwhile for large claims, because of the expense of litigation."
