• A dangerous vehicle charge against express deliveries haulier TNT was thrown out of court last week after a prosecution error invalidated its evidence.
TNT appeared before Carlisle Magistrates on the charge of permitting one of its trucks to be used in a dangerous condition. The truck, a 7.5tanner, had run away on a hill on Lowther Street, Carlisle, in April 1999 and hit a wall.
Accident investigators had stripped the truck and found that, although the handbrake was not faulty, a couple of the brake discs on the other axle
had cracks in them. Although this would not have caused the accident, the investigators nevertheless recommended a summons with the charge of using a motor vehicle in a dangerous condition.
But an administrative error meant the summons went out with the charge of permitting a vehicle to be used in a dangerous condition.
The brake discs were produced.in court, but the magistrates agreed with TNT's defence that there was no evidence to suggest TNT knew about the cracks and that the case should be dismissed.
