THE ROAD HAULAGE Association (RHA) will submit a petition in October urging the Home Office to review statutory fees and other laws on recovering LGVs as soon as possible.
The RI IA Rescue and Recovery Group (RRG) points out that the £105 set statutory fee for recovering a vehicle is -not commercially viable". It wants the legislation to differentiate between the 'action of recovery' (getting the vehicle into a position allowing it to be safely removed from the road) and 'removal' (taking the vehicle from the highway to a place of safety).
The group is keen for as many recovery operators and hauliers to sign the petition as possible. It will then be taken on a recovery vehicle to London on 23 October and handed in to the Home Office with a letter from RHA chief executive Roger King.
RRG manager Heat her Wallace says: "We're urging the Home Office to review the legislation. Progress is very, very slow."
The amount a recovery operator can charge an operator to take away a broken-down vehicle became news during a recent court case. Mansfield Group took NYK Logistics to court over unpaid recoverycharges and the (undisclosed) fee was upheld (CM 15 June).
The Home Office is to carry out a review of statutory charges but a date has not yet been set (CM 10 August).A consultation document is being prepared.
