An EU Commission Interpretative Communication (2005/C 21/02) issued in January 2005 defined that operations must comply with the definition of the Court of Justice in terms of "duration/frequency, continuity and periodicity of service provision". Activities not to be in line with this are:
• Permanent, exercised continually and regularly • Those carried out systematically and not just on an ad-hoc basis • Those which involves a vehicle belonging to a non resident haulier, where the vehicle in question never leaves the terrority of the host state.
