DRIVER Douglas Wilkinson of Kelso gave his farm-owner em ployer nine time sheets showing longer hours at work than recorded on his tachograph in 1983/84.
He claimed to have switched off because the statutory working time had been exceeded. When he damaged the farmyard it was the last straw said his employer, who claimed careless driving and dismissed him.
The Industrial Tribunal, Scotland, upheld the right of the employer to dismiss him because of the several kinds of trouble he had caused to his employer.
It also ruled that sufficient warning had been given and dismissed a claim for unfair dismissal.
