Workers Union is hoping to reverse a 1992 industrial tribunal decision in April in a case which could have drastic implications for private companies taking over public-sector contracts (see feature page 36).
The union is representing 22 Eastbourne Council workers including refuse vehicle drivers who lost their jobs when a con tract was awarded to private waste disposal operator Onyx.
The case pivots on the UK Transfer of Undertakings Regulations, which are being extended to local authorities and other employees in non-commercial ventures as part of the Trade Union Reform and Employment Rights Bill.
The case has implications for thousands of local-authority workers.
In a recent Irish case the European Court of Justice ruled that claims resulting from a failure to enact EC legislation could be backdated to 1981 when the European Act was passed.
