Anthony Ostrin, prosecuting for VOSA, told the court an Iveco four-axled tipper with a gross plated weight of 31,000kgs carrying hardcore was weighed and found to be overloadedlbe first axle was overloaded by 450kgs,some 7.14%.An inspection revealed one of the truck's outer tyres was deflated, which could compromise control while driving. The VED had expired more than two months before the check.
Jeremy Fear, defending, argued that Morrissey was no longer a haulier. He had found it difficult to check the weight and the tax was an oversight. The tyre deflation had occurred during the course of the journey.
