Ltd. against the decision of the Metropolitan deputy Traffic Commissioner, refusing to grant a variation of the conditions of a road service licence for excursions and tours so as to authorize an additional sightseeing tour of London, has been allowed by the Minister of Transport.
The Minister considered that the need for the proposed tours had been too lightly weighed by the deputy Commissioner and, referring to the Ministry inspector's report, noted that the services offered by Frames Tours stood in need of some protection. The appellants had freely admitted that there might be abstraction and this had been agreed by the respondents. The Minister also noted the arrangements under• which passengers were introduced to tours by travel agencies, who, from the evidence, he said, tended to deal with particular operators rather than others. Nevertheless, the Minister considered that, on balance, protection should be afforded by a levelling of road fares and by prohibiting the appellants from operating tours during the evenings when Frames Tours were licensed to operate, and similarly on Sunday mornings. •
