I Having assisted Joan Ruddock MP in pushing through her Private Members Bill and the Department of the Environment in drawing up the regulations necessary to implement it, the LWRA is certainly not "disappointed" by the seizure provisions of the Control of Pollution (Amendment) Act 1989.
We have used it and will use it again whenever the opportunity arises.
Next month we have another weapon in our fight against fly-tippers. Under Section 33(5) of the Environmental Protection Act 1990 any person having control of a motor vehicle used in the commission of an illegal deposit of waste will be treated as knowingly causing the offence.
Identifying the actual driver will therefore no longer be necessary. Beware!
