A RECYCLING company's appeal against a cut in its licence authority has been partly successful. The Transport Tribunal has directed that the curtailment from nine vehicles and nine trailers to four vehicles and four trailers should be amended to seven vehicles and seven trailers.
In January, Western Traffic Commissioner Philip Brown ordered that Recycled Waste Transport of Bristol have its licence cut to four vehicles and four trailers with effect from the end of August. He added that it would be varied to seven vehicles and seven trailers if there was a satisfactory maintenance assessment by Vosa in June or July.
In December 2004 the company had its licence curtailed to six vehicles and six trailers for 30 days because of its vehicle maintenance record. Between January and November 2005 one immediate and 11 delayed prohibitions had been imposed on the company's vehicles, The Tribunal agreed with the TC that some form of action was required. Unfortunately, the TC did not explain why he chose to bring the curtailment into effect seven months after the public inquiry when it was clear that immediate action was necessary The right Course would have been to cut the licence to seven vehicles and seven trailers to take effect by the end of February, to order a further maintenance assessment in June or July, and adjourn the public inquiry until September.
