AN OVERLOADED vehicle driven by an agency driver, who admitted not checking its weight despite the fact he felt the vehicle "looked heavy", led to Deeside-based FTS Hatswell being ordered to pay fines and costs totalling £1,148 by the Ellesmere Port 8c Neston magistrates.
The company, of Deeside Industrial Park, Welsh Road, Deeside, admitted using the vehicle when the maximum permitted gross weight had been exceeded.
Magistrates were told that last July a 7.5-tonne vehicle driven by Gareth Davies was given a roadside check on the A5117 at Dunkirk. The vehicle was weighed and found to be overloaded. The maximum permitted gross weight of 7,500kg was exceeded by 1,490kg, equal to an overload of 19.87%, and the maximum permitted first-axle weight of 3.200kg was exceeded by 710kg, equal to an overload of 22.19%.
When questioned, Davies said he was employed by Driver Hire Nationwide, which was subcontracting him to FTS Hatswell. He confirmed that he had not weighed the vehicle before starting the journey. He said: "1 thought the vehicle looked heavy and I mentioned it to the supervisor from Hatswell. He then moved the load forward:.
When interviewed, the company confirmed that Davies had been employed through an agency and he had received his instructions from operations manager Keith Mitchell.
The company was tined £1,000 with £148 costs.
