A FIRM THAT operated without a transport manager for over three years has lost its revocation appeal to the Transport Tribunal.

Kishore Balu, trading as Alpha Transport Services, based in Wednesbury lost his licence after failing to respond to letters from the West Midland Traffic Area Office about the resignation of his nominated transport manager.

In September 2007, Balu's transport manager Sukjaben Tirwana notified the Traffic Commissioner that he had resigned in December 2004, adding that he was unaware that he should have notified the TC earlier.

The Traffic Area Office wrote to Balu asking him to provide details of arrangements to nominate a replacement transport manager. Further correspondence followed and in the absence of any replies the licence was revoked.

In appealing, Balu stated that Tirwana had not given him any notice of his resignation, with the result he had very little time to reemit a new candidate to fill the position, that it had taken time to recruit a new candidate and for the individual to find the necessary certificates.

Dismissing the appeal, the Tribunal said that Balu had failed to respond to any letters until the licence was revoked.

If what Balu had stated was correct it meant he had failed to notice the absence of a transport manager between December 2004 and April 2008, which in itself was an unacceptable state of affairs. The TC had been plainly right to revoke the licence.
