A SELF-EMPLOYED driver, who admitted to falsifying his tachograph records and failing to take a weekly rest, has had a weekend curfew order imposed for a period of eight weeks.
The order involves the driver being tagged and Group 4 fitting a monitoring box at his home.
Robert Salisbury, of Back Bower Lane, Gee Cross, Hyde, pleaded guilty to four offences of falsification and one weekly rest offence when he was called before Rochdale Magistrates.
Prosecuting for Vosa, John Heaton said that Salisbury had been driving for Oldhambased CDI Haulage as a sub-contractor. He had driven beyond the time when he should have taken a weekly rest, and had tried to conceal the fact by creating tacho charts in the name of his brother, Alan, who was also a driver.
Evidence came into Vosa's possession that his brother had been driving his own vehicle on the same day. When interviewed, Salisbury admitted what he had done, saying: "I did it, it was me driving and not my brother." Salisbury said Chris Sheering, CDI's director, had not known precisely what driving he had done since the company he was on gave him the work. He had nothing to say in mitigation as he was guilty.
In reply to the Magistrates, he said he sometimes started work at dinner-time on a Sunday after having had a full weekly rest.
The Magistrates said they the curfew order would keep him at home at weekends.
