• International hauliers are calling for the introduction of an independent arbitration service to settle insurance claim disputes for goods they blame. lessly lose on journeys abroad.
The Road Haulage Association is investigating whether a binding decision from a third-party mediator could avoid hauliers falling out with valued customers over insurance liability. Under current international catTiage CMR rules the haulier is not liable for a loss if it was caused "through circumstances which the artier could not avoid and the consequences of which he was unable to prevent."
But hauliers often have difficulty in proving to their customer that their drivers were not to blame for losses, especially in the case of fire or hi-jackings.
