• )perators who lost out when north-east haulier Barnfather crashed last year have just a few more weeks to wait before knowing if the directors can be pursued through the courts for the lost money.
Barnfather liquidator Ernst & Young says it is at a delicate stage of negotiations with prefer ential creditors in its bid to persuade them to give up their right of first pickings from Bar nfather's remaining assets But by September the liquidator says it should know whether the preferential creditors, such as the Inland Revenue and the VAT office, will give up their position. This would allow the formation of a legal fighting fund.
If the preferential creditors refuse, it is highly unlikely the unsecured creditors will have any chance of winning the hundreds of thousands of Pounds owed them.
