• The Transport and General Workers Union is claiming victory after the High Court decided last week the union's appeal of unfair dismissal for 17 Eastbourne council workers could be referred back to industrial tribunal.
A Brighton industrial tribunal rejected the TGWU's claim last year that the Transfer of Undertakings (Protection of Employment) Regulations (TUPE) had applied to council workers, including refuse vehicle
drivers, who lost their jobs in 1990, when the Council contracted street cleaning work out to private contractor Onyx.
But an Employment Appeal Tribunal ruled last week that the original Brighton tribunal decision was "flawed" and had not taken into account other similar cases elsewhere in Europe.
The TGWU has permission for an early tribunal hearing and is confident it will win that appeal. It is seeking reinstatement or compensation for the workers.
