ACCORDING TO the rules set out in the Trade Union and Labour Relations Act (Consolidation) 1992, when a company is planning to make between 20 and 100 staff redundant it must give 30 days' notice and 90 days' warning if more than 100 staff are affected.
This law also states the employer must deal with the union or, if there is no union presence, appoint a member of staff to act as a representative for those employees affected and discuss the options available.
Because none of this happened at Pawson and Macfarlane, 11 Macfarlane staff and one Pawson driver challenged their redundancies.
