If they are still unsatisfied at the end of this process a complaint can be taken to an employment tribunal , The Recruitment and Employment Confederation says the accused employer bears the burden of proof if the complainant can first make out a basc case to the tribunal. Effectively the employer must prove he or she did not discriminate. However, all complaints must be taken to a tribunal within three months of the act that is complained about.
