II Volvo Contract Services is being sued by a Littlehampton haulier who claims it refuses to refund his down payment after he cancelled a contract-hire agreement.
David Bailey of DR Bailey had taken a batch of 10 Volvo FH12s on a 36-month contracthire deal, which included a nopenalty get-out clause after 13 and 25 months.
When he exercised his option to terminate the contract after 25 months he expected to receive a remit tance of £43,000 equal to the three-months instalments paid up front.
Bailey claims this was a refundable deposit, but he says Volvo argues it was simply a large initial payment and refuses to pay.
The matter is now with Bailey's solicitors, Thomas Eggar Church Adams, which has issued a High Court writ against Volvo Contract Services. Volvo intends to defend the writ in court, but will make no other comment.
