A Godaiming firm has lost its bid for an Operator's Licence due to its contrued use of vehicles without authority.
Partners Mark Hinton and Marcus Thornton-Allen, trading as Design Drives, had applied for a new two-vehicle licence before the South Eastern & Metropolitan Deputy Traffic Commissioner Roger Lockwood.
Hinton accepted that he had been Convicted of unauthorised use in February 2002, and that a further case was pending relating to the unauthorised use of a vehicle on 13 September 2002.
He told the DTC that he had not appreciated the seriousness of the offences. He was only compelled to face up to the gravity of the situation when they received the call-up [etter.
For the partners, Jonathan Lawton said
that the use of small goods vehicles was peripheral to the main activity Of the business, which was the design and installation of ornamental drives.
The Dr refused the application on the grounds that Hinton had lost his repute.
The OTC said that not only had he been found guilty of using an unauthorised vehicle in February 2002, it was clear that
he had continued to do so further six months.
