A TRANSPORT lawyer has warned of trouble ahead when operators receive a letter demanding details of their transport manager to fulil the requirements of new regulations.
The letter from the central licensing ofice in Leeds explains the changes affecting O-licences under the European Commission’s Access to the Occupation Regulations, which come into force in the UK on 4 December.
A transport manager questionnaire is enclosed, which must be completed by the transport manager and operator by 17 October. Operators must say whether their transport manager is internal or external and what CPC qualiications he has.
The regulations ban external transport managers from being nominated for more than four operations with a total leet of 50 vehicles.
Where a transport manager works for more than one irm, a form must be completed for each operation.
Information collected will be used to meet the requirements of the pan-European register of operators, which goes live in 2013.
Also new is a ban on operators using a PO box number or thirdparty address.
Transport lawyer Tim Ridyard of Woodines Solicitors says parts of the form are simpler than previous versions.
“But, overall, I think it will lead to more omissions and mistakes. I see trouble ahead.”
