Second vehicle remains impounded

HURSTPIERPOINT-BASED Kevin Varney has lost his bid for the return of a second impounded vehicle.
The South Eastern and Metropolitan Traffic Commissioner, Christopher Heaps. also refused to return the vehicle to Shane Saunders, of East Grinstead, who claimed that the vehicle was his because Varney had not kept up the instalments to buy it from him.
The TC was told that the vehicle was impounded in July after it was seen entering Beavers Farm Fisheries, Felbridge. The driver had said that he was employed by Varney. In April 2003 Varney was convicted of a series of offences, including having no 0-licence. In January another vehicle owned by Varney was impounded and no application for its return was made.
The TC said Varney had confirmed that he had agreed to purchase the vehicle from Saunders.There was no evidence to show that title was retained by Saunders pending payment of the final instalment.
A letter from Transport Management Consultants stated that the vehicle was, and remained, the property of Varney. Heaps concluded that Varney was the owner and that it had been used unlawfully without an 0-licence.
