D Damages of £730 awarded to Birningham Corporation in the High Court )11 Thursday of last week for damage to )ne of their buses in a road crash included 314 compensation for loss of use while it vas being repaired.
Mr. Justice Geoffrey Lane, giving judgnent in London after hearing the action at lirmingham • Assize, entered judgment vith costs against Mr. John William lowsbery, who drove his van into the offide of a Corporation bus on Christmas :.ve 1965.
He had admitted negligence and liability to pay the cost of repairs but contested the Corporation's claim for damages for loss of use of the vehicle during the 69 days' repair period.
It had been argued that the Corporation did not have to hire another bus because they maintained a spare fleet of buses, and being non-profit-making there was no financial detriment.
The judge decided that the Corporation were entitled to compensation at £4 1 is a day--the cost of maintaining a spare fleet of buses for such emergencies.
