System wilfully disregarded licence refused

• The Western LA has refused, in writing, an application for two vehicles by Mr A. F. McColl, of Southville, Bristol.
Mr J. Cox, Western area secretary of the RHA, made representations on behalf of two directors of Coronation Transport Ltd, a business with which Mr McColl was once connected.
The LA, Mr J. R. C. Samuel Gibbon, stated in his decision that while he could rely on the evidence of Mr J. F. Clague, one of Coronation's directors, he found it impossible to take the same view of the applicant's.
The applicant freely admitted he had been operating unlawfully but it had been impressed on the LA that he should take into account the previous good character for the past 15 or 20 years. However, stated the LA, the evidence of previous good character seemed slight when compared with the wilful disregard of the licensing system.
The applicant also wished that the affairs of Coronation be considered but the LA said the evidence before him was quite inadequate and there was little which could enable him 'to exercise his discretion in Mr McColl's favour.
Maintenance arrangements were also considered to be unsatisfactory and the application was, therefore, refused.
