Regarding the right to silence (CM25-31January) your story is a fair statement of the current position and, despite Messrs Shulman's comment, it would be a foolish driver who pinned his hopes on an ECHR appeal. Much easier just to stay law-abiding.
For clarification, I would point out that the decision overturning the Scottish High Court decision was made by the UK House of Lords. I do not know the nationality of those Lords who heard that particular case, but they could have been drawn from any part of the UK.
Such is the nature of appeals at the highest levels where the individual countries lose their own legal systems and everything converges.
